The car was not as promised. Speak to Kestrel.

Used car turned out to be a lemon?. The law of England and Wales, in plain English.

The law, in plain English

Buy from a dealer and the Consumer Rights Act 2015 applies: the car must be of satisfactory quality for its age, mileage and price, and as described. Serious faults within 30 days allow outright rejection and refund; within six months, faults are presumed present at sale unless the dealer proves otherwise. On finance, the finance company often shares liability, which gives you another route. Private sales carry far fewer rights: the car need only match its description.

How it usually goes

  1. Stop using the car for anything non-essential and report the fault to the dealer in writing immediately.
  2. Rejection or repair demand in writing, copied to the finance company if there is one.
  3. Refusal: a formal letter, then county court; independent inspection evidence helps.

What it costs

Rejection letter £180 plus VAT · claim from £450 plus VAT (illustrative).
